Fox News is reporting that Sen. Adam Schiff, D-Calif., is under criminal investigation for alleged mortgage fraud, citing a Trump administration source. The source told Fox News host Laura Ingraham on The Ingraham Angle Tuesday night that the U.S. Attorneyβs Office in Maryland is leading the probe, which could result in charges tied to fraudulent loan practices.
This comes about a month after the Federal Housing Finance Agency (FHFA) reportedly sent a criminal referral to the Justice Department, accusing Schiff of repeatedly falsifying bank documents and property records to secure better loan terms.
According to Fox, a 2011 affidavit shows then-Congressman Schiff certifying a property in Montgomery County, Maryland, as his primary residence. However, Schiff also owns a condominium in Burbank, California, which he has listed as his primary residence as recently as 2023 during his U.S. Senate campaign. His office has not responded to Fox News Digitalβs request for comment.
In May, FHFA Director William Pulte sent a letter to Attorney General Pam Bondi and Deputy Attorney General Todd Blanche outlining alleged misconduct, stating that Schiff βin multiple instancesβ misrepresented occupancy status between 2003 and 2019 for a Potomac, Maryland, home. Pulte wrote that such allegations, if true, could undermine the safety and stability of the U.S. mortgage market.
The letter also referenced a memo from Fannie Maeβs financial crimes unit, which alleged Schiff engaged in βa sustained pattern of possible occupancy misrepresentationβ involving five Fannie Maeβbacked loans.
Records indicate Schiff and his wife bought the Maryland property in 2003 for $870,000, obtaining a $610,000 Fannie Maeβbacked mortgage with a 30-year term at a 5.625% interest rate by declaring it as their primary residence. The couple reaffirmed that status during multiple refinancing applications between 2009 and 2013, despite Schiff serving in Congress for California at the time.
According to Pulte, they only reclassified the property as a secondary residence in 2020. During the same period, Schiff claimed a homeownerβs tax exemption on his Burbank condo, designating it as his primary residence and receiving a $7,000 property tax reduction.
The FHFA letter asserts that Schiffβs alleged conduct may violate several federal statutes, including wire fraud, mail fraud, bank fraud, and making false statements to financial institutions. Pulte also claimed Schiff appeared to knowingly falsify records to gain favorable mortgage terms.
In 2023, a Schiff spokesperson told CNN that both the California and Maryland addresses had been listed as primary residences βbecause they are both occupied throughout the yearβ and to distinguish them from a vacation property.
